Independent Medical Exams (IMEs)
TYPICAL STEPS
Lawyers phone Dr. Layne to discuss their cases, then mail all records to him and
contact him to schedule the evaluations, at his office or theirs. Days
after his face-to-face exams, which can take from 3-6 hours, Dr. Layne mails his reports which
include line-by-line reviews of every record, and analyses of litigants'
histories, behaviors, tests, diagnoses, causes of all mental ills, and
prognoses. His reports contain tables, graphs, and scientific citations that can
be enlarged and used later as trial exhibits.
FEES
Hourly fees are $300 for records review, interviewing, and
report writing, and totals around $2300 per case. Neuropsychological cases
often total about $3000. In addition, Layne charges $200 an hour for travel,
$400 an hour for deposition
and trial testimonies, and may charge $200 for cancellations with less than 48
hours notice.

Layne does not evaluate litigants without seeing them face-to-face. When he
must evaluate records alone, without seeing the litigant, he repeatedly
makes clear that he is evaluating records, rather than the
litigant.
PERCENT BREAKDOWN OF HIS ACTIVITIES
Attorneys often ask Dr. Layne for a percentage breakdown of his professional
activities. This is difficult, because Dr. Layne, like most professionals, does
not keep and analyze time logs; and even if he did, these percentages probably
change over time, making a single estimate more difficult. Still, here is a
rough breakdown of Dr. Layne's private practice activities over the last decade:
Evaluations for litigating attorneys = 35%; other evaluations = 35%; counseling
= 30%.
